POLITICAL OPPOSITION PLATEFROM P5 MEMORANDUM ON THE SITUATION OF HUMAN RIGHTS IN RWANDA

Abstract

By this memorandum, the P5 PLATFORM, a coalition composed of 5 main political organizations of the Rwandan democratic opposition: Amahoro –  PC, FDU – Inkingi; PDP – Imanzi; PS –  Imberakuri and Rwanda National Congress (RNC), would like to share its concerns with the European Parliament in the face of an explosive human rights situation that is developing every day in Rwanda.

RWANDA: FDU-INKINGI CONDEMNS THE RWANDAN REGIME’S TACTICS TO CONCOCT CRIMINAL CHARGES AGAINST ITS LEADERSHIP.

We have learnt, from reliable sources,  that the ruling party in Rwanda, RPF, is repeating its old dirty tactics of using false identities to catch unsuspecting members of the opposition. In this regard, it is sending agents all over the country claiming to be members of FDU-Inkingi in order to trap innocent citizens and they are also framing people as members of FDU-Inkingi as they desperately seek false charges against the leaders of our party. They are looking for new people to arrest as if the plight of the 8 members of the FDU-Inkingi who are unjustly held by the police were not enough.

RWANDA: FDU-INKINGI SECRETARY GENERAL MR SIBOMANA SYLVAIN AND HIS COLLEAGUE MUTUYIMANA ANSELME IN COURT APPEAL AGAINST POLITICALLY MOTIVATED CHARGES

Mr Sibomana Sylvain and his colleague Mutuyimana Anselme have appeared today December 4, 2017 in court to appeal against the common political charge of encouraging insurrection levelled against critics of the RPF regime. The hearing is taking place when the regime is doing everything possible, including repression and deceit, to uproot le FDU-Inkingi from the Rwanda political landscape. But it also happens at a time when the African Court for Human and People’s rights has ruled in the case of the President of FDU-Inkingi, Mrs Victoire Ingabire Umuhoza, that article 463 (Organic Law 01/2012/OL, that is used to criminalise free speech, like in her case and the case of Sibomana and Mutuyimana, violates the Universal declaration of human rights, the African charter on human and peoples’ rights and the international convention on political and civil rights.

Rwanda: The UDF -Inkingi welcome s the Judgement of the African Court of Human and Peoples ‘ Rights in the case of Political prisoner Victoire Ingabire Umuhoza

We have learnt with satisfaction the judgement of the African Court of Human and Peoples ‘ Rights, based in Arusha -Tanzania) in the case of the political prisoner, Mrs Victoire Ingabire against the Rwandan government, confirming that she did not get a fair trial in Rwanda, highlighting several violations of her Rights including freedom of expression and absence of internationally recognised standards relating to her legal defence.

CONDEMNATION OF THE VICIOUS ATTACK ON THE CEO OF HUMAN RIGHTS WATCH BY RWANDAN PARLIAMENT

The Rwandan political opposition party, FDU-Inkingi, condemns in the strongest terms possible the vicious personal attack on the Chief Executive officer of Human Rights Watch (HRW), Kenneth Roth, by the Rwandan parliament, something that depicts the depravity of the political system in Rwanda. It is sad and pathetic for a parliament and a national human rights commission to help cover up human abuses by the Executive and for “Honourable” members of parliament to use abusive language against whistle blowers on human rights abuses. They should rather thank HRW for filling the gap left by their omission.

RWANDA : THE SENTENCE OF THE FDU-INKINGI LEADERS IN THEIR TRIAL IN APPEAL FOR PROVISIONAL RELEASE WAS DELIVERED IN THE ABSENCE OF DIPLOMATIC REPRESENTATIONS, THE MEDIA, AND HUMAN RIGHTS OBSERVERS.

Away from diplomatic representations, the media and human rights observers, in an empty room, on October 24, 2017, the judge of the Court of Appeal in Kigali, Rwanda, decided to keep in custody 7 members of FDU-Inkingi. They includes the First Vice-President, Boniface Twagirimana, and his colleagues: Fabien Twagirayezu, Gasengayire Léonille, Gratien Nsabiyaremye, Evode Mbarushimana, Norbert Ufitamahoro, Theophile Ntirutwa , and Papias Ndayishimiye who confessed that under torture the police extracted confession from him. They are all accused of belonging to a fictitious armed group called P5. The second prosecution witness, Ernest Nkiko, who was expressly recruited by the Directory of Military Intelligence (DMI) was released.

P5 PLATEFORM CALLS TO END GENERAL PAUL KAGAME IMPUNITY: RWANDAN REGIME BLOCKS UN SCRUTINY OVER ITS PRACTICE OF TORTURE.

P5-Plateform would like to call on the UN to condemn publicly practice torture in Rwanda and to come out to put pressure on the Rwanda government to respect international conventions that it has ratified. The complacency of the international community has encouraged repression in Rwanda to an irreversible level and has sowed seeds of future instability in Rwanda and in the Great Lakes Region.

News reports have confirmed that “the United Nations Subcommittee on Prevention of Torture” (SPT) has suspended a visit to Rwanda due to a series of obstructions imposed by authorities, such as accessing some places of detention, confidentiality of certain interviews and over concerns that some interviewees could face reprisals. The delegation suspended the visit on day five of their planned seven-day mission which was supposed to stay in Rwanda from the 15 – 21 October 2017.

Apart from visiting places of detention and giving interviews to inmates, the delegation of the Subcommittee on Prevention of Torture (SPT) aimed to advise the Rwandan authorities on the establishment of a national detention monitoring body officially known as the National Prevention Mechanism (NPM) to monitor Rwanda’s compliance to the Optional Protocol to the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT) which Rwanda ratified in June 2015.

RWANDA: PROSECUTION WITNESS IN THE CASE AGAINST FDU-INKINGI LEADERSHIP HAS CONFESSED THAT HIS EVIDENCE WAS EXTRACTED UNDER TORTURE

It has now become a tradition for the ruling party RPF to get government critics arrested and detained arbitrarily and then paraded before the Rwandan courts, which are completely subservient to the RPF dictatorship, to be accused of forming armed groups to overthrow its dictatorship.

On 17/10/2017, the leaders of the FDU-Inkingi arrested on the 6th September 2017, and whose case is still in progress, have not escaped this rule. Stratagem is exactly the same; as was for the case with Victoire Ingabire Umuhoza, President of the FDU-Inkingi, the RPF finds informers who are arrested at the same time with the suspects, only to be used later as prosecution witnesses. The one who excels in playing his/her part in the police drama is well rewarded. Before it was the “Major” Vital Uwumuremyi alias Kalimba Gaspard , currently it is Janvier Twagirayezu who was quickly released after giving evidence against the accused. Papias Ndayishimye, who acted as “Colonel” Tharcisse Nditurende in the case of Mrs Victoire Ingabire Umuhoza, has just confessed that the police extracted confession to him under torture.

Rwanda: Appeal for an end to relentless persecution of FDU-Inkingi members: case of Anselme Mutuyimana.

The FDU-Inkingi political party opposed to the repressive regime of President Paul Kagame would like to appeal to all peace-loving people and governments as well as human rights organisations to put pressure on the Rwandan government to end the persecution and torture of its members. We would like to draw the attention of the public on the continued psychological and physical torture of Anselme Mutuyimana held in Nyanza prison.

We have raised the pathetic situation of Mr Anselme in our earlier press releases but the situation has deteriorated after the FDU-Inkingi leadership was arrested and detained on trumped charges. He is regularly beaten and put in solitary confinement in a very squeezed prison cell.

RWANDA: NEPHEW OF MISS GASENGAYIRE ARRESTED AS THE WITCH HUNT FOR FDU-INKINGI LEADERSHIP RUNS AMOK

We have learnt from reliable sources that a nephew of Miss Leonille Gasengayire, Mr Theoneste Dusengimana of Kivumu sector, Rutsiro district was arrested yesterday and taken to Kivumu police station. He is waiting to be transferred to Kayove Police station. We are afraid that the witch hunt may extend to all relatives and friends of the FDU-Inkingi leaders who have been arrested and call for all peace-loving people and organisation to condemn this dangerous trend.

Rwanda : CALL TO SAVE THE LIFE OF MR THEOPHILE NTIRUTWA

The FDU-INKINGI opposition party urges the Rwandan Government to say whereabouts of Théophile Ntirutwa. The government security services have not been able to inform his family, his lawyer or his party where he is since his arrest a week ago. He is the only once among the other leaders of the FDU-Inkingi who has not been shown to a lawyer.

Theophile Ntirutwa had been abducted by the DMI in September 2016 and kept for three being tortured before being abandoned on the road.

We are afraid that he is being tortured again and may end up with the fate of other FDU-Inkingi activists, including JD Habarugira, or anther activist, murdered on May 8, 2017 and Ms. Iragena Illuminee, abducted on March 26, 2016 and is feared dead.

It is therefore clear that the dictatorial regime of General Paul Kagame seeks to annihilate our political party by physically eliminating some of its members.

CALL FOR AN END TO TERROR UNLEASHED ON MEMBERS OF FDU-INKINGI BY RWANDA’S SECURITY SERVICES

The FDU-inkingi would like to make an appeal to all peace-loving people, institutions and governments to rein on the government of President Kagame to release its members detained on trumped up charges. We call for the respect of the minimum standards for the treatment of detainees particularly regarding access to their families and to food. So far families have not been able to see their loved ones and to bring them food. They are handcuffed 24 hours.

On the 6th September 2017, the Rwandan police unleashed terror on members of FDU-Inkingi, arresting its members including a lady who is volunteer and helping with party accounts, a driver, a gate keeper and a domestic employee, allegedly for sensitizing the youth to join an armed group based in an unnamed neighbouring country, a charge brought against any political dissident who is arrested.

Rwanda: THE ARREST OF FORMER PRESIDENTIAL HOPEFUL Ms DIANE RWIGARA , FDU-INKINGI AND PDP-IMANZI MEMBERS, KICKS OFF THE POLITICAL PROGRAME OF PRESIDENT KAGAME 3RD TERM.

During the swearing in ceremony of the new cabinet on Thursday August 31, 2017 President Kagame gave, in a veiled language, instructions to the Minister of Justice to prosecute former presidential hopeful Diane Rwigara when he stated that all those who embezzle public money should be prosecuted and that “those who were presidential candidates and lost do not enjoy immunity from prosecution”, intimating to him: “you know what I mean”.

Indeed, two days ago, the police had raid on the Rwigara’s family home and arrested all the present members. The day after the Kagame speech, four journalists who were investigating the whereabouts of Rwigara family have been threatened to be arrested by the Presidential body guard who were patrolling the area. Tuesday on the 4th September 2017, can be construed to be a quick response to the President’s instructions. She was arrested with her mother and sister, thus sending a chilling message to government critics about government policy towards the opposition in the next seven years: “you either keep quiet or you will be in trouble. It is not only you but your family that you are putting at high risk”.

RWANDA: THE FDU-INKINGI OFFICES IN KIGALI ARE UNDER SIEGE

We have just learnt from reliable sources, that the police raided the FDU-Inkingi headquarters in Kigali and handcuffed all those who were present including:

1. Boniface Twagirimana: First Vice-President;

2. Fabien Twagirayezu responsible for mobilization;

3. Gasengayire Léonille: Assistant Treasurer;

4. Alphonse: Employee;

5. Julien: security guard.

They are currently under intense interrogation.

At the same time, systematic searches have been carried out at the house of Mr. Nsabiyaremye Gratien Assistant Commissioner of FDU-Inkingi. He has been arrested at the school where he is teaching at Rutsiro and is being brought to the capital Kigali.

RWANDA: OPPOSITION PLATFORM STRONGLY CONDEMNS THE POLICE HARASSMENT OF MISS DIANE RWIGARA AND HER FAMILY.

The Rwandan political opposition platform composed of political organisations Amahoro PC, FDU – Inkingi, PDP – Imanzi, PS –Imberakuri and Rwanda National Congress‐ RNC would like to condemn in the strongest terms the raid of the family house of Ms Diane and her family members and taking them to an unknown location.  The family was not given the opportunity to talk to its lawyer.

When questioned about the incident the police spokesman confirmed the raid, but said that it was carrying out preliminary investigations into suspected tax evasion and forgery.
