Rwanda: Political prisoner Ingabire before the Supreme Court for the merit for a constitutional review of contentious genocide ideology laws.

The Supreme Court introduced the case on constitutional review filed by the opposition leader Madame Victoire Ingabire Umuhoza against genocide ideology laws threatening freedom of expression and the rule of law. In this case the respondent is the government of Rwanda represented by a legal team from the Ministry of justice. On foot of specific application to the Supreme Court, the parties having carriage of proceedings before the court were informed that only lodged written submissions will be considered and that there will be no hearing. The ruling is due on 13 April 2012.

Rwanda: Ingabire political trial adjourned to 02 April 2012 to allow constitutional review

The High Court has adjourned to 02 April 2012 the political trial of the opposition leader Madame Victoire Ingabire to get ready for the Supreme Court Constitutional review starting on 27 March 2012, at 08:00. In the last two days, the defendant was examined by the judges on the evidential material from The Netherlands. Serious concerns about the accuracy and credibility of the controversial testimony of Madame Speciose Mujawamariya have emerged from both sides.

RWANDA: PROSECUTOR RELEASES ADDITIONAL INDICTMENT IN INGABIRE POLITICAL TRIAL.

Yesterday, the National Public Prosecution Authority (NPPA) revealed the key points of the additional indictment based on evidential allegations from the Netherlands. From the bunch of the much touted 600 pages, the prosecution is relying on 4 documents to lay the ground for the political prisoner to be life- sentenced for her alleged role in plans to carry out terrorist acts inside the country: the first document’s heading is “24 February”; document nr.2 “action plan inside”; document nr.3 talks about education project to citizenship; the fourth document is a long testimony containing statements and police interrogations of Madame Spéciose Mujawamariya. None of those documents was signed by Ms Victoire Ingabire Umuhoza. There are no names, no full dates on the three papers. Even the prosecution acknowledged that Ingabire is not the author but should explain why the papers were in her house in Hollandwhile she is in maximum prison inRwanda.

RWANDA: ABDUCTED OPPOSITION MEMBER ICYITONDERWA FREE AFTER TORTURE.

Yesterday we echoed a press release from the Parti Social Imberakuri in Rwanda confirming the kidnapping at gunpoint of Mr. Jean Baptiste Icyitonderwa, the party mobilisation secretary. Today, he reappeared alive, head covered, under shock, scared, weak and telling of torture. He refused to comment in depth his 7 day ordeal after he was abandoned tightened in plain night in Nyarugunga valley by unnamed armed kidnappers who allegedly threatened to kill him if he does not quit the opposition. This case and other accounts of ill-treatments against civilians underscore the need for the government of Rwanda to put an end to politically motivated attacks.

RWANDA: INGABIRE POLITICAL TRIAL RESUMES. THE HIGH COURT SUSPENDS DEBATES ON GENOCIDE ALLEGATIONS UNTIL CONSTITUTIONALITY RULING.

On 12 March 2012, the political trial of the opposition leader Ms. Victoire Ingabire Umuhoza resumed. About 200 people from all the folks attended the hearing, and some of them donned pink, a symbol of the prison uniform in solidarity with all Rwandan political prisoners. The High Court decided to suspend all debates related to genocide ideology in this case until the Supreme Court rules on the defendant petition to nullify the controversial law. The hearing is continuing on charges which the Prosecutor suggests amounts to recruitment etc. into an armed force, complicity in terrorist acts and willingly disseminating rumors aimed at inciting the public against the existing leadership.

RWANDA: POLITICAL PRISONER INGABIRE REFUSED ULTRA VIRES LAWS IN THE KANGAROO PROCESS.

Today, the political prisoner Ms. Victoire Ingabire Umuhoza, imprisoned leader of FDU-INKINGI, has petitioned the Rwandan Supreme Court to challenge the constitutionality of ultra vires aspects of articles 2 to 9 of the LAW N°18/2008 OF 23/07/2008 RELATING TO THE PUNISHMENT OF THE CRIME OF GENOCIDE IDEOLOGY because they are not in accordance with the rules laid down by the current constitution of Rwanda.  Article 145 of the Constitution gives to the Supreme Court the judicial review powers and latitude to analyze laws in terms of their constitutionality. If the Court finds the law unconstitutional, it will be nullified.

In another different high court motion, the opposition leader has  today subpoenaed the Minister of Defense and the Foreign affairs Minister to appear before the High Court and testify on alleged assassination plans targeting an exiled national inSouth Africa, as revealed in a prosecution testimony filed by the National Public Prosecution Authority in her case.

RWANDA: AUTHORITIES CONTINUE TO EMBEZZLE PUBLIC FUNDS WITH IMPUNITY

Kigali, February 23, 2012.

Over 20 billion (20,000,000,000) Frw or $40 million US dollars have been embezzled from Rwanda national treasury.

One gets these numbers by putting together figures and spreadsheets that were recently made public in a report written by the Public Accounts Committee (PAC), a commission of the Rwandan legislative assembly, in charge of monitoring the utilization of public funds and assets.

The report which was presented to the legislative assembly on February 15, 2012 illustrates the bad stewardship of public funds and assets during the fiscal year 2009-2010.
